General terms and conditions
The current terms of sale and purchase (hereinafter « Conditions / Terms ») are applicable between the GEMO S.A.R.L. (GEMO Ltd) (hereinafter « we/us/ our ») and any professionals (hereinafter « you/your ») who will undertake a purchase throughout the website http://www.g-silver.com (hereinafter « website »).
Terms and conditions are subject to changes. The new terms and conditions of sale and purchase will be valid from the date the website is released. The General Terms and Conditions valid at the time the contract is concluded shall be valid.
We reserve the right to modify, suspend or stop all, or parts of the services provided by the website at any time. Anyone who has placed an order on the website will be notified beforehand.
1. Terms agreement
You acknowledge having read and agree to the present Terms and Conditions before placing your order. When ticking the box: ‘I accept the general terms and conditions of purchase’, you accept the current Terms and Conditions without reservations as well as the confidentiality policy attached to it.
No particular condition, neither verbal nor written conditions of sale completed through any type of material, can rule against the present conditions except from our formal and written acceptance.
The fact that we might not comply with any of the dispositions stated in the present Conditions at any time, does not mean that we renounce to use in succession any of these dispositions.

3. Placing an Order
3.1 Concluding the sales contracts:
The buyer wishing to purchase a product must:
- Fill in all the required fields in the application form
- Fill in the order form online and give all the references of the chosen product
- Check and validate the order
- Make a payment following the Terms and Conditions
- Confirm the order and the payment method
Once the order is validated you will receive a confirmation via e-mail that will sum up the key features of the order (quantity, packaging, and message, latest date of delivery, amount, and delivery address)
If you have any questions, you can browse the “Help Online” section, available on the website or contact our Customer Services.
We might not follow up incomplete or incorrect orders, or any order that does not show enough liability. In the case of a product being out of stock, you will be informed via e-mail that the contract is not concluded and that the order has been cancelled, specifying the reasons of cancellation.
3.2 Your Account and following your order
When placing an order online, you have to open a user’s account and provide personal details from the organisation you are buying from on the website (character of the organisation, European Union VAT number...)
Once your account is open, you can access the heading “My Account” at any time, from the home page of the G-Silver.com’s website to check the status or the history of your order. You can also update your personal details.
3.3 Modify or cancel your order
The revocation right is regulated by the civil code and the general policies in terms of revocation.
Some modifications of the order are possible at our discretion and within the limits of availability of the product.
4. Availability of the product
If the product shown on the website is out of stock or being sold at the time you last accessed the website or when sending the order form, you will be informed as soon as possible, within 30 days following the transfer of the order.
If the payment has already been made, you will be fully reimbursed.
5. Prices and reductions
Prices on the website are in Euros before tax and do not include delivery charges (see Section 7.4 of the current Conditions).
We use a sliding scale of charges depending on the amount purchased for one order only. Delivery and processing charges are not taken into account when calculating these charges.

6.1 Methods of payment
To make a payment for a product and delivery charges, you have the possibility to follow one of the methods proposed on the order form of the website.
Payments through PayPal are accepted via the following address: firstname.lastname@example.org
Debit cards are debited on the day the items are ordered.
Debit cards accepted for online shopping are: Amex®, MasterCard® and VISA®. The bank account matching up your debit card will be debited immediately after the order has been validated.
Direct debit payment: if you choose this method, the transfer must be made within 10 working days following the order. If not, the order will be automatically cancelled. The items will be dispatched once the amount due is accredited on the following current account:

6.2 Safety of the transactions
All transactions made on the website are secure. Banking details relating to customers (i.e. credit/debit card number or expiry date) are encrypted by the SSL system, and then dealt with by our financial partner.
The customer’s card number cannot be identified at any time; it will be transmitted directly to our banking society through a protected connection.
Your details are not conveyed through the website and only our banking society has access to this information.
A statement will be sent for each delivery.
7. Shipping and delivery
7.1 Delivery address
Items will be delivered to the address mentioned when ordering online. This address can be different from the billing address.
7.2 Delivery time
The delivery time mentioned once your order has been placed is the period within which you will receive your goods. We will do our best to ensure that the items ordered are delivered before the deadline, so that you can enjoy the product as soon as possible.
When paying by direct debit, the delivery time will take effect on the day the payment has been received on our bank account.
Delivery time between the confirmation of your order and the receipt of your parcel shall be approximately 10 working days. This delivery time is calculated automatically from the orders placed before yours and still being processed.
7.3 Shipping and delivery methods
Items from the same order may be placed in different packages. However, they will be dispatched simultaneously.
If the person the parcel is addressed to is absent on delivery of the package, a notice will be placed in the mail box. The receiver will then have to contact the number given and arrange a new time for redelivery. After 5 days, we will not be responsible for any damages caused to the parcel or the item due to inadequate retaining conditions.
If the package has not been claimed after 14 days, it will be automatically returned to us. You may contact our Customer Services and ask for a redelivery of your item, which will be made at our own expenses. However, we are not responsible for any damages caused by additional transportation.
For every order placed on www.g-silver.com you will receive a statement where all the items dispatched will be stated. Details given by the customer when placing the order shall be deemed authentic.
We strongly recommend that you check your items thoroughly on receipt, and mention any reservations about the delivery order, especially if the product has been damaged or in case of discrepancy.
Once the delivery form has been signed, you will not be able to dispute the quality of the item dispatched.
If the item delivered does not correspond to the order placed, you must inform us by e-mail to the following address email@example.com within 3 days after receipt of the items.
You are strongly advised to inform the mailing company and ourselves about your reservations within 3 days after receipt of the items.
7.4 Shipping costs
When determining the delivery costs of your items, we take into account the total average weight, which is the actual weight of the product ordered as well as the weight of the delivery packaging.
The delivery cost is calculated automatically by the G-silver.com’s website, depending on the destination and the weight/ value of the parcel. The cost will be determined once the country, town and postcode are mentioned in the shopping cart. There will be no additional cost paid by G-Silver, given that the delivery cost is exactly the same as the one stated by the mailing company.
Please, note that all delivery costs are calculated and indicated when you place an order.
7.5 Modifying details before the dispatch of your order
If the status of your order has been sent, we will not be able to change the details relating to the dispatch or billing of your order.
If your order has not been dispatched yet, you can contact our Customer Services. Your request will then be taken into account.
8.Returns and exchanges
We commit ourselves to give you a refund or to replace the items that may be lost, apparently damaged, or that may not comply with your order.
In such a case, you may contact our Customer Services. If your request is acknowledged, you can return the item in question. The items must be returned entirely and in their original package. On receipt of your parcel, we will replace the item or reimburse the amount on your order entirely or partly.
9.Warranty and prices
We only propose high quality products on our website. These products are bought directly from producers who are carefully selected because of their rigorous monitoring over quality. We do not sell second-hand products, products that present irregularities or items showing lower quality compared to the products sold on the market.
The fundamental characteristics of the products are presented on our website on a listing page. However, the colours and pictures of the products sold on the website could vary depending on t the Internet browser used or the computer screen.
Prices may be updated. We suggest you check carefully the final cost before sending your order form: in any case, once the order has been placed, prices will not vary.
Any dispatch without a destination will not be accepted.
We are not to be held responsible in case of any delay or non-execution of one or several of the obligations established in this contract resulting from unexpected events or a case of absolute necessity.
We do our best to represent and describe accurately the characteristics of the items shown on the website. However, we are not to be held responsible for any minor discrepancy between the description of the online product and the product dispatched.
In addition, we are not to be held responsible for any inconvenience or damage caused by the use of the web, particularly in case of disruption of the service, external intrusion, or computer viruses.
11. The legal guarantees
You benefit from the legal guarantee of conformity and the guarantee of the redhibitory vices following the articles from the Consumer’s Code and the Civil Code:
Article L.211-4: The seller is obliged to deliver goods in conformity with the contract and will be responsible for the lack of conformity at the delivery time. He will also be responsible for the lack of conformity resulting from the packaging, mounting instructions or installation when the contract stipulates that the seller is in charge of the installation or the installation is performed under his responsibility.
Article L.211-5: In order to conform with the contract, the goods must:
1- be specific for the customary usage expected from comparable goods and, if necessary:
- correspond to the description given by the seller and have the qualities that the seller presented to the buyer in the form of a sample or model;
- have the qualities that a buyer can legitimately expect on account of the advertisements made by the seller, by the producer or by his representative, particularly in terms of publicity or labeling;
2- Or have the characteristics defined by common agreement by the parties, or be specific to any special usage sought by the buyer, indicated by the buyer to the seller, and for which the seller has thereby agreed to.
Article L.211-12: The legal guarantee of conformity shall be valid for two (2) years as of the goods delivery date.
Article. 1641: A seller is bound to a warranty on account of the latent defects of the thing sold which render it unfit for the use for which it was intended, or which so impair that use that the buyer would not have acquired it, or would only have given a lesser price for it, had he known of them.
Article. 1648: The action resulting from redhibitory vices must be brought by the buyer within two years from the time the vice has been discovered.
12. Intellectual property
http://www.g-silver.com’swebsiteand the totality of its contents , whether visual or auditory, as well as underlying technology, are protected under copyright law of the brands or patents. They are the exclusive property of the Gemo S.A.R.L (Gemo Ltd).
All total or partial reproduction or representation of the contents of this website by any person or company would be considered as infringement committing the civil and penal responsibility of its author.
Using a hypertext link to http://www.g-silver.com, using « framing » or « deep linking » is strictly forbidden.
You are committed to support and pay compensation (particularly law costs and lawyers expenses) to Gemo S.a.r.l., its representatives, its employees or its partners for any complaint or protest, resulting from any non execution or disrespect, on any account from your part or anyone using your account, of obligations and guarantees stated in the present Conditions.
14. Personal data and confidentiality policy.
Your personal data is necessary for you to open an account, manage your order, and to our commercial relationship.
In accordance with the law dated 6th of January 1978 relating to data processing, files and personal freedom and privacy, you have the right to access, modify and delete your personal data. This data is sent only to us by accessing the “My Account” section or when writing to our Customer Services.

Parties agree that the present contract is subject to French law.
